Welcome to callout.jp. callout.jp is operated by susuROBO株式会社 ("Company", "we", "our", or "us") and provides an outbound calling and AI-assisted communication service designed to help users complete legitimate business and administrative tasks.
These Terms of Service ("Terms") govern the relationship between the Company and the entity or individual ("Customer", "you", or "your") who accesses or uses our services, applications, or platform (the "Services") through https://callout.jp.
Please review these Terms carefully, together with our Privacy Policy, which describes how we collect and use personal data. Together, these documents form a legally binding agreement (the "Agreement").
By accessing or using the Services, you agree to be bound by this Agreement. If you do not agree, you must not use the Services.
1. Access to the Services
We may modify, suspend, or discontinue the Services, in whole or in part, at any time at our discretion. While we aim to provide reliable access, we do not guarantee uninterrupted availability, uptime, or error-free operation unless expressly agreed in writing.
Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable right to access and use the Services.
You are responsible for maintaining the security of your accounts and ensuring compliance with this Agreement.
2. Use of the Services
By using the Services, you represent that you are at least 18 years old, or the minimum age of legal consent in your jurisdiction.
You agree not to use the Services to transmit or process sensitive personal data, including medical, financial, or government-issued identification information, unless strictly necessary and legally permitted.
You are solely responsible for all content, instructions, scripts, prompts, and communications ("Content") initiated through the Services.
You retain ownership of your Inputs and, to the extent permitted by law, the Outputs generated by the Services. We may process Content solely to provide, operate, maintain, and improve the Services, enforce these Terms, and comply with legal obligations.
3. Call Purpose and Usage Restrictions
The Services are provided solely for legitimate, task-oriented, and lawful communications.
You expressly agree to the following restrictions:
- No marketing or promotional calls
The Services may not be used for telemarketing, advertising, lead generation, or sales outreach. - Business-related calls only
Calls must be directed to businesses, service providers, or organizations. Calls to private individuals or purely personal numbers are prohibited unless you have a legitimate business purpose and lawful authority to do so. - No prank, deceptive, or abusive calls
You may not use the Services for harassment, prank calls, impersonation, deception, or any activity intended to mislead or cause harm. - No unlawful surveillance or recording
You must comply with all applicable laws regarding call recording and transcription. - No public sharing of call content
You may not publicly post, publish, or share call audio recordings or transcripts. Doing so may violate privacy and telecommunications laws, including Japanese privacy regulations.
You are responsible for ensuring that each call complies with all applicable local, national, and international laws.
4. Prohibited Activities
You may not:
- reverse engineer, decompile, or attempt to derive the source code of the Services,
- interfere with or disrupt the integrity or security of the Services,
- use the Services to create a competing product,
- resell, sublicense, or offer the Services on a standalone basis,
- introduce malware or malicious code,
- use the Services for any unlawful purpose or outside the scope expressly permitted by these Terms.
5. Termination
We may suspend or terminate your access to the Services at any time if you violate these Terms or use the Services in a manner that creates legal or operational risk.
Upon termination, you must immediately stop using the Services. Fees already paid are non-refundable unless required by law.
6. Payment and Billing
If you purchase paid Services, you agree to provide accurate billing information. Payments are processed through third-party providers and are non-refundable except where required by law.
7. Intellectual Property
All intellectual property rights in the Services, including software, trademarks, and documentation ("Company IP"), belong to the Company or its licensors. No rights are granted except as expressly stated in these Terms.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee the outcome, accuracy, or success of any call or communication made using the Services.
9. Limitation of Liability and Indemnification
To the maximum extent permitted by law, the Company will not be liable for indirect, incidental, consequential, or punitive damages. Our total liability will not exceed the fees paid by you in the 12 months preceding the claim.
You agree to indemnify and hold us harmless from any claims arising from your use of the Services or violation of these Terms.
10. Dispute Resolution and Governing Law
This Agreement is governed by the laws of Japan, without regard to conflict-of-law principles.
Any disputes arising out of or relating to this Agreement shall be resolved exclusively by the Tokyo District Court as the court of first instance, unless otherwise required by mandatory law.
